CONDICIONES DE LA SUBASTA/
SALE CONDITIONS
1º
La puja inicial es en Euros y es el precio mínimo al que puede adjudicarse cada lote. Este precio
actua como reserva y no se puede adjudicar por debajo
2º
Al precio de adjudicación se le añadirá un 20% de comisión más los gastos de envío y/o seguro.
Los gastos de envío de los artículos adquiridos es fijo y se facturará con carácter general con
independecia de la condición o residencia del adquiriente con IVA INCLUIDO al amparo del
Régimen Especial de los bienes usados, objetos de arte, antigüedades y objetos de colección.
3º
Si no puede asistir personalmente a la Subasta, envíe sus ofertas tan pronto como sea posible.
Los lotes son vendidos al precio más barato posible y no al importe de puja. Por ejemplo, un
lote de 1.000 € que Vd. puja 3.000 € y la oferta más alta anterior a la suya es de 1.500 €, se le
adjudicará a Vd. en la puja siguiente, en este caso 1.600 €. A igualdad de pujas, gana la recibida
con anterioridad y la recibida a través de nuestra web oficial o cualquier otra de nuestras
plataformas. Algunos lotes pueden tener una reserva impuesta por el vendedor.
4º
Las pujas deberán efectuarse en EUROS; cualquier puja en otra moneda, será convertida en
EUROS. Los pagos deben realizarse en Euros. El importe recibido en otra moneda será sujeto al
cambio del día de la recepción de la orden o del pago.

Los compradores deberán efectuar el pago a la recepción de la factura. A la recepción
del pago, los lotes serán enviados por correo siempre que el comprador no nos haya dado
instrucciones distintas.
6º
SOLER Y LLACH, S.L. se reserva la facultad de agrupar a su criterio dos o más lotes de la presente
Subasta así como de retirar cualquier lote
7º
SOLERY LLACH S.L. se reserva el derecho de admitir o rehusar la entrada de un cliente a la sala
de subastas así como de rehusar una oferta por escrito. El subastador es quién regula las pujas y en
el caso de cualquier disputa entre compradores, su decisión final es la válida.
8º AUTENTICIDAD.
Todos los lotes vendidos a través de SOLER Y LLACH S.L. tienen garantizada su
autenticidad. Cualquier reclamación al respecto debe ser comunicada a SOLER Y LLACH, S.L.
dentro de 30 días posteriores a la fecha de la Subasta. El comprador pierde todos los derechos de
reclamación después de este período.
9º
Los lotes serán subastados en su condición actual y no se aceptarán reclamaciones por
restauraciones o daños. Aunque las descripciones se realizan de manera exhaustiva, los
compradores tendrán que comprobar, antes de la subasta, que las descripciones corresponden a
su opinión pesonal sobre el lote. De todos modos no se aceptarán reclamaciones transcurridos 30
días de la fecha de la Subasta.
10º
Lotes de conjunto y colecciones no pueden ser devueltos. Se recomienda un detenido
examen para tener un completo conocimiento del contenido del lote.
11º
La puja mínima aceptada para todos aquellos lotes con precio de salida LIBRE es de 5 EUROS.
12º
Es obligación del comprador cumplir con las disposiciones fiscales y aduaneras vigentes en
España.
13º
FACILIDADES de pago para compras superiores a 500 €.
El comprador puede escoger pagar
a la recepción de la factura el 30% de su importe, y el resto en un período máximo de seis meses
en cuotas mensuales iguales. Cada final de mes, SOLER Y LLACH, S.L. cargará en la cuenta del
comprador un interés del 0,50% sobre el saldo deudor. Los lotes quedarán en poder de SOLER
Y LLACH S.L. hasta su pago total. De acuerdo con el apartado nº 8, el comprador pierde todo
derecho a reclamación transcurridos 20 días de la Subasta, pudiendo en este lapso de tiempo
examinar los lotes en SOLER Y LLACH, S.L.
14º Retrasos en el pago.
Si el pago de la factura, en parte o en su totalidad no ha sido satisfecho
por el comprador en un plazo de 30 días después de celebrada la Subasta, SOLER Y LLACH, S.L.
se reserva el derecho de anular la venta y disponer del lote(s) y/o reclamar judicialmente la suma
debida, así como los daños y perjuicios ocasionados. SOLER Y LLACH, S.L. cargará en la cuenta
del comprador un interés del 0,50% cada final de mes sobre el saldo deudor, más cualquier gasto
que conlleve la demora. El comprador que incumpla estas condiciones, no tendrá derecho a
reclamación alguna en ninguna circunstancia.
15º
. Los lotes adquiridos pueden ser retirados de nuestras oficinas en Beethoven 13 - 08021
Barcelona, a partir del día indicado en cada catálogo y hasta 15 días después de la Subasta.
16º PROPIEDAD
. Los lotes permanecerán propiedad del vendedor hasta que el pago se haya
realizado totalmente, lo que incluye el abono de cheques o cualquier otro documento.
17º
La mera participación en la Subasta implica la aceptación de las presentes condiciones.
18º
Cualquier caso de litigio será sometido a los tribunales de Barcelona.
19º
El Estado Español, de conformidad con la Ley 9/1993 de Patrimoni Cultural Català (DOGC
núm. 1897 de 11 de octubre de 1993) Art. 22 y Ley 16/1985 de 25 de junio de 1985 de Patrimonio
Histórico Español (BOE núm. 155 de 29 de junio de 1985) Art. 38, tiene el derecho a adquirir
cualquier lote al precio de adjudicación

SOLER Y LLACH, S.L. no se hará responsable de la interrupción en la modalidad on-line por
causas mayores o deficiencias imputables a terceros.
21º
El texto que obliga a las partes implicadas en la Subasta es el publicado en castellano,
quedando otras versiones sometidas a las originales en castellano.
1st
The starting price is expressed in Euros and it is the lowest price at which a lot can be awarded.
This price must be considered a reserve price, and it will not be decreased.
2nd
The hammer price will be increased by a 20% commission/buyer’s premium plus shipping and/
or insurance. The shipping cost of the awarded articles is fixed, regardless of the residence address
of the purchaser, and will include VAT in compliance with the Specific Regime for used goods,
works of art, antiques and collector’s items.
3rd
If you are unable to attend the Auction personally, please send us your commission bids as
soon as possible. Lots are not necessarily sold for the amount of your bid, but at the lowest available
price. For instance, it you bid € 3.000 for a lot with a starting price of € 1.000 and the highest bid
below yours is € 1.500 the lot will be awarded to you for € 1.600. If there are two identical bids, the
one received first and the bids received through our website and other platforms are given priority.
Some lots may have a reserve price imposed by the vendor.
4th
Bids must be made in EUROS. Bids in any other currency will be converted to EUROS. Payments
have to be made in EUROS. The amount received in another currency, will be subject to the daily
Bank exchange rate.

Payments for lots awarded are due upon receipt of invoice. Upon receipt of payment, we will
despatch the material by mail unless otherwise requested.
6th
SOLER Y LLACH, S.L. reserves the right to group together two or more lots in this Auction and to
withdraw a lot or lots from this Auction at its discretion.
7th
SOLER Y LLACH, S.L. reserves the right to admit or refuse a customer entrance to the auction
room as well as the right to refuse a written bid. The Auctioneer will regulate the bidding. In the
event of any dispute, his decision is final.
8th AUTHENTICITY.
All lots sold through SOLER Y LLACH S.L. are guaranteed to be genuine. Any
claim in this respect must be brought to the attention of SOLER Y LLACH, S.L. within 30 days of the
Auction date. The buyer loses his right to file claims after this period.
9th
The
lots will be auctioned in their present condition, and no claims will be accepted for
restorations or damages. Even though the descriptions have been done very thoroughly, the buyers
will have to make sure before the Auction that these descriptions correspond to their personal
opinion about the lot. In any case, no claims will be accepted after 30 days of the Auction date
10th
Multiple lots and collections cannot be returned. We recommend a thorough examinatio
to have a complete knowledge of its contents.
11th
The lowest bid accepted for those lots with a LIBRE starting price is 5 EUROS
12th
It is the buyer’s responsability to make himself aware of any legal and/or customs regulations
currently in force in Spain.
13th PAYMENTS for purchases superior to 500 €.
The buyer may choose to pay 30% of the total
value upon receipt of the invoice and to pay the remaining balance in six equal instalments
over the following 6 months. SOLER Y LLACH, S.L. will charge interest of 0,50% on the outstanding
balance at the end of each month. The lots will remain in the possession of SOLER Y LLACH, S.L. until
full settlement of the account. The lots may be examined by the buyer in our offices within 30 days
after the Auction date, after which he loses his right to any claims according to paragraph 8 of our
sale conditions.
14th Late payments.
If payment has not been received within 30 days after the Auction date,
SOLER Y LLACH, S.L. reserves the right to cancel the sale and award the lot(s) to another and/or
initiate legal proceedings in order to collect the amount due in addition to damages and loses
incurred. A charge of 0,50% plus expenses will be charged each month on overdue payments. The
buyer in default shall have no right to any claims in any circumstances.
15th
The awarded lots can be retrieved from our offices in Beethoven 13 - 08021 Barcelona from
the date shown in each catalogue until 15 days after the Auction.
16th PROPERTY.
Lots remain the property of the seller until full payment has been received,
including clearance of checks and bills of exchange.
17th
Participation to the Auction implies the acceptance of the present conditions.
18th
Any legal proceedings concerning this Auction will be governed by the exclusive jurisdiction
of the Courts of Barcelona.
19th
The Spanish Government, according to Law 9/1993 of Patrimoni Cultural Català (DOGC núm.
1897 de 11 de octubre de 1993) Art. 22 and Law 16/1985 de 25 de junio de 1985, of Patrimonio
Histórico Español (BOE núm. 155 de 29 de junio de 1985) Art. 38, has the right to claim any awarded
lot at the hammer price.
20th
SOLER Y LLACH S.L. will not be responsible for the interruption of participation in on-line mode
for reasons beyond our control.
21st
The text that governs the parties concerned in the Auction, is the one published in Spanish; all
other versions are subjected to the originals in Spanish.
